by

Alliance for a Green Economy has filed a friend of the court brief supporting a legal challenge against New York’s $7.6 billion nuclear subsidies. The amicus brief highlights how New York’s Public Service Commission violated state law and overstepped its authority when approving a massive bailout for four upstate nuclear plants. The brief reviews how the Public Service Commission has broad authority to enact policy and rates to support energy efficiency and rewewable energy but lacks authority to pass policies that support New York’s struggling nuclear industry.

The brief can be read in full here.

The brief supports a legal challenge brought by the envrionmental organization, Hudson River Sloop Clearwater, and a number of plaintiffs, including other environmental organizations, local businesses, private citizens, and a municipality. The original legal challenge can be found here.
